General Terms and Conditions of Sale
Article 1 – Scope of Application
These General Terms and Conditions of Sale (hereinafter the “GTCS”) apply, without restriction or reservation, to all sales concluded by BARLET SŒURS, the Seller (hereinafter “Barlet Sœurs”), with non-professional buyers or professionals acting outside the scope of their activity (hereinafter the “Client(s)”), wishing to purchase the products offered for sale (hereinafter the “Products”) on the website barletsoeurs.com (hereinafter the “Site”), published by the company SAS ANNE SOPHIE BARLET, whose registered office is located at 7 Rue Saint Isaure, 75018 Paris.
The GTCS set out the rights and obligations of the Client and of Barlet Sœurs for any purchase of products via the Site. These GTCS are accessible at any time on the Site and shall prevail over any other document.
Acceptance of the GTCS is mandatory to validate any order. The Client therefore declares that they have read and accepted them by ticking the box provided for this purpose before initiating the online order process.
Unless proven otherwise, the data stored in Barlet Sœurs’ computer system constitutes proof of all transactions concluded with the Client.
The choice and purchase of a Product is the sole responsibility of the Client.

Article 2 – Client Account
To place an order, the Client is invited to create an account.
To do so, they must register by providing the information requested at the time of their order and agree to provide sincere and accurate information regarding their identity and contact details.
The Client is responsible for updating the information provided, which may be modified by logging into their account.
To access their account and order history, the Client must identify themselves using their username and password, which are strictly personal. They must not disclose them; otherwise, they remain solely responsible for their use.
Barlet Sœurs reserves the right to close a client account and refuse any order in the following cases:
• A dispute relating to the payment of a previous order is ongoing;
• Non-compliance with the obligations defined in the GTCS;
• The quantities ordered do not correspond to normal use by a consumer acting for non-professional purposes;
• Several serious and consistent elements give rise to suspicion of fraud.
Deletion of an account results in the permanent deletion of all personal information of the Client.
The Client may request the closure of their account at any time by sending a request to mailto : contact@barletsoeurs.com. It will take effect within a reasonable timeframe.
Article 3 – Product Availability
The products displayed on the Site are offered for sale as long as they are available. A product that becomes unavailable may be marked as “Sold”.
The main characteristics of the Products are presented on the Site, which the Client is required to review before placing an order.
Each Product has a detailed page describing its essential characteristics: designation, key features, photograph, price. All product photographs or information are non-contractual and provided for reference only. Differences in perception of shapes and colours between images and the actual products cannot incur the liability of Barlet Sœurs.
Production and delivery times are detailed on each product page.
If a product becomes unavailable after payment validation, the Client will be informed by email or phone as soon as possible, the order will be cancelled, and the Client will be fully refunded within 5 days.
No cancellation compensation (other than full refund) may be claimed, as such unavailability results from delays in updating the Site.
Adding a product to the cart does not constitute an order; the product may become unavailable between the time it is added to the cart and the time the order is validated.
Article 4 – Prices
Products are supplied at the prices in force on the Site at the time the order is registered by Barlet Sœurs. Prices may be modified at any time without notice.
Prices are listed in euros, excluding delivery fees. Delivery fees are indicated before order confirmation and depend on the destination.
Prices include all applicable taxes (VAT included). Any change in VAT rates will automatically be reflected in product prices. However, for Products shipped outside the European Union, prices are automatically calculated excluding VAT on the invoice.
Article 5 – Order and Validation
It is the Client’s responsibility to select the Products they wish to order on the Site, as well as the delivery method.
After creating a client account, the Client places an order according to the instructions displayed on the Site.
A summary of the order is then shown. After checking their cart, the Client clicks “Buy”. Validation of the order implies full acceptance of the GTCS.
The data recorded by Barlet Sœurs constitutes proof of all transactions between Barlet Sœurs and the Client. Payment system data constitutes proof of financial transactions.
Barlet Sœurs confirms receipt of the order by email. The sale is considered concluded only upon confirmation of the order by email, subject to full payment.
The Client must check the order details and immediately report any error.
Any order placed constitutes a distance contract between the Client and Barlet Sœurs.
Barlet Sœurs reserves the right to cancel or refuse any order from a Client in the cases listed in Article 2.
Article 6 – Delivery, Shipping Fees and Receipt
Products are offered for sale for the countries listed when entering the delivery address.
For international orders, the Client is the importer of the Products. Customs duties or other local taxes may apply and are the Client’s responsibility.
Products are shipped within 6 days from the date of order. Delivery times depend on the carrier and destination and are not guaranteed.
Barlet Sœurs undertakes to use its best efforts to deliver within the indicated timeframes (obligation of means).
If Products are not delivered within 30 days of ordering, except in cases of force majeure or Client fault, the Client may terminate the sale in accordance with Articles L.216-6 and following of the Consumer Code.
Delivery is carried out by UPS to the address provided by the Client.
In case of special packaging or transport requests approved in writing by Barlet Sœurs, additional costs will apply.
Upon receipt, the Client must:
i) check the condition of the package(s);
ii) write handwritten reservations on the carrier’s delivery note in case of visible damage;
iii) inform Barlet Sœurs immediately.
In case of visible damage, the Client must refuse delivery.
The Client has 3 business days from receipt to report any issue by email with supporting evidence (photos). After this period, Products are deemed compliant.
Article 7 – Transfer of Ownership
Ownership is transferred to the Client only after full payment, regardless of the delivery date.
Article 8 – Payment Terms
Payment is made securely by credit card (Visa, Mastercard, American Express).
Payment must be made in full on the day of ordering.
All transactions are SSL encrypted. Payment data is never stored on Barlet Sœurs’ server.
Payment is considered final only after actual collection by Barlet Sœurs. If payment is refused, the order cannot be validated or shipped.
Barlet Sœurs is not required to deliver Products if the price has not been fully paid.
Article 9 – Returns and Withdrawal
9.1 Applicable Law

9.2 Exercise of the Right of Withdrawal
Article 9.2.1 – Procedure
The Client may exercise their right of withdrawal online, using the form below or any unambiguous statement sent by post to the address indicated in Article 1.
Returned Products must be in their original condition and complete (packaging, accessories, instructions), suitable for resale, and accompanied by the purchase invoice. Damaged, worn, or incomplete Products will not be refunded.
Return shipping costs are borne by the Client unless otherwise stated.
Article 9.2.2 – Refund
Barlet Sœurs will refund the full order amount excluding shipping fees, using the original payment method unless otherwise agreed.
Barlet Sœurs may reduce the refund amount in case of wear or damage exceeding what is necessary to establish the nature and proper functioning of the Products.
9.3 Exceptions
Personalised or custom-made products (unique pieces, engraving, special enamel work) cannot be returned, in accordance with Article L.221-28 of the Consumer Code.
Article 10 – Legal Guarantees
The products supplied are covered by the statutory warranty of conformity (Articles L.217-4 to L.217-13 of the French Consumer Code) and by the warranty against latent defects (Articles 1641 to 1648 of the French Civil Code):
The consumer has a period of two years from the delivery of the goods to invoke the statutory warranty of conformity in the event that a lack of conformity appears. During this period, the consumer is only required to prove the existence of the lack of conformity, and not the date on which it appeared.
When the sales contract provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the statutory warranty applies to that digital content or digital service throughout the duration of the supply period. During this time, the consumer is only required to prove the existence of the lack of conformity affecting the digital content or digital service, and not the date on which it appeared.
The statutory warranty of conformity requires the professional seller, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The statutory warranty of conformity entitles the consumer to repair or replacement of the goods within thirty days of their request, free of charge and without significant inconvenience.
If the goods are repaired under the statutory warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.
If the consumer requests repair but the seller imposes replacement, the statutory warranty of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction of the purchase price, keeping the goods, or may terminate the contract and receive a full refund upon returning the goods if:
1° The professional refuses to repair or replace the goods;
2° Repair or replacement occurs after a period of thirty days;
3° Repair or replacement causes major inconvenience for the consumer, particularly if the consumer ultimately bears the costs of returning or collecting the non-compliant goods, or if they bear the installation costs of the repaired or replacement goods;
4° The lack of conformity persists despite the seller’s unsuccessful attempt to restore conformity.
The consumer is also entitled to a price reduction or to termination of the contract when the lack of conformity is so serious that it justifies an immediate reduction of the price or termination of the contract. In such cases, the consumer is not required to request repair or replacement beforehand.
The consumer is not entitled to termination of the sale if the lack of conformity is minor.
Any period during which the goods are immobilized for repair or replacement suspends the warranty period until the goods are returned to the consumer.
The above rights arise from the application of Articles L.217-1 to L.217-32 of the French Consumer Code.
A seller who obstructs the implementation of the statutory warranty of conformity in bad faith is liable to a civil fine of up to €300,000, which may be increased to up to 10% of the average annual turnover (Article L.241-5 of the French Consumer Code).
The consumer also benefits from the statutory warranty against latent defects pursuant to Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if they keep the goods, or to a full refund upon returning the goods.
To assert these rights, the Client must inform Barlet Sœurs in writing (by email or letter) of the non-conformity of the products or the existence of latent defects as soon as they are discovered.
In the event that the Client identifies a defective or non-compliant product, they may contact Barlet Sœurs for an assessment of the issue. If the warranty applies under the conditions described above, Barlet Sœurs will refund, repair, or replace the product, and will reimburse the return shipping costs upon presentation of the corresponding receipts.
Refunds, replacements, or repairs of Products deemed non-compliant or defective will be carried out as soon as possible and no later than 30 days after Barlet Sœurs confirms the lack of conformity or the latent defect. The refund will be made by bank transfer or cheque.
The warranty provided by Barlet Sœurs is, in any case, limited to the replacement or refund of Products that are non-compliant or affected by a defect.
Article 11 – Liability
11.1 Website
Barlet Sœurs uses reasonable means to ensure access, security, and proper functioning of the Site. The Client acknowledges possible interruptions due to maintenance, technical failures, internet issues, intrusions, viruses, or force majeure.
Barlet Sœurs shall not be liable for:
• temporary site unavailability;
• connection difficulties;
• data loss or consequences of technical failure or malicious acts.
11.2 Products
Barlet Sœurs is not liable for:
• improper or non-compliant use of Products;
• normal wear and tear;
• force majeure events.
Article 12 – Intellectual Property
All Site content is the exclusive property of Barlet Sœurs. Any full or partial reproduction without written consent is strictly prohibited.
Article 13 – Archiving / Proof
Barlet Sœurs’ digital records constitute proof of transactions and communications.
Article 14 – Applicable Law / Disputes
These GTCS are governed by French law.
Clients may use consumer mediation services. The designated mediator is CNPM MEDIATION CONSOMMATION.
The Client may also use the Online Dispute Resolution platform.
Any unresolved dispute shall be referred to the courts within the jurisdiction of the Paris Court of Appeal.
Article 15 – Data Confidentiality
For information on data processing and rights, refer to the Privacy Policy available on the Site.
